TANTANGAN KEBIJAKAN MENGENAI ARAH E-ARBITRASE DI INDONESIA

Penelitian ini menganalisis keterbatasan Undang-Undang Nomor 30 Tahun 1999 dalam mengakomodasi arbitrase digital serta merumuskan model E-arbitration Framework Indonesia. Metode yang digunakan adalah hukum normatif dengan pendekatan konseptual dan perbandingan. Hasil penelitian menunjukkan bahwa ketiadaan pengaturan eksplisit mengenai kontrak elektronik, tanda tangan digital, bukti elektronik, serta prosedur dan putusan arbitrase digital menimbulkan ketidakpastian hukum dan hambatan dalam praktik, khususnya pada tahap pembuktian dan eksekusi. Secara praktis, kondisi ini menurunkan efisiensi dan kepercayaan pelaku usaha terhadap arbitrase nasional. Penelitian ini menawarkan model E-arbitration Framework yang terstruktur melalui integrasi aspek normatif, institusional, prosedural-teknis, teknologi, dan kapasitas sumber daya manusia, dengan berlandaskan asas otonomi para pihak, kepastian hukum, dan efisiensi. Kontribusi penelitian ini terletak pada perumusan model konseptual-operasional sebagai dasar reformasi hukum arbitrase Indonesia yang adaptif dan aplikatif.
